Article 1- Preamble
The present general conditions of sale apply, in an exclusive way,
between CONVERT DESIGN SRL, Bucuresti, Maria Rosetti 7-9, ap.6, 020481 Romania
(hereafter “We” or “Us”) and any person making an order request via our
Internet site (hereafter “You”). Any user must be aware of the General Conditions of sale on the Internet
site www.ledagallery.com
(hereafter the “Site”). These general Conditions of sale can be subjected to
modifications, the applicable conditions are those in force on the Site at the
date of your order request.
Article 2 - Purchase
Conditions: You declare to be at
least 18 years old and to have the legal capacity or to have a parental
authorization allowing you to make an order on the Site.
Steps:
1. You fill up the order request form (buy online).
2. You
receive the corresponding offer.
Option 1 –
You accept the offer
3. You
proceed to payment. You have 48 hours to proceed to payment after receiving the
offer.
4. When
payment is received, You receive the invoice with mention "paid" in
pdf format.
5. You can
get your purchase.
Option 2 – You refuse the offer
3. You tell
us or not about your refusal. All offers remained without any answer or action
from your part will be cancelled within forty eight (48) hours.
Option 3 – We reject your order request
We reserve
the right to refuse or reject any order request at our own convenience.
Article 3 - Price, availability
and delivery
Price: The
prices posted on the Site are indicated in euros all local taxes, except
delivery fees, and custom charges. The invoices are written and payable in
euros. We reserve the right to modify the prices at any time, without notice,
nor notification. Only the order requests in progress will not be affected by
the price changes except exceptional cases.
Availability: The articles on sale on the Site can constantly be unavailable
or withdrawn from the Site. We reserve the right to delete or modify the
Articles and their contents at any time, without notice, nor notification.
These changes or suppressions cannot result in any type of compensation. Only
the payments in progress will be refunded (see payment) and the outstanding
offers will be cancelled.
Delivery:
Organized by You: You can
organize yourself the delivery of your article, You just have to inform us on
the order request. when the payment is received , you be will be informed by
e-mail and You will be able to organize the transport of your purchase or to
pick it up by yourself. All necessary information will be communicated in this
e-mail.

if We organize for You the transportation of your purchase, all
information relating to the shipment will be then communicated to You to get an
up-to-date delivery status. The date of delivery will be defined by the company
of transportation. Note: Convert Design declines any responsibility for all
damage direct or indirect, body, accidental, special, consecutive, financial
and different which occurs directly or indirectly and related to
transportation. The articles will be always ensured according to their value.
You have to pay for the insurance and transportation charges, except in case of
our preliminary written agreement.

Article 4: Customs fees - Any order made on the Site and
delivered in another country than the country of origin could be subjected to
possible taxes and customs fees which are payable when the package arrives at
its destination. These customs fees and these possible taxes related to the
delivery of your article have to be paid by You and concern only your
responsibility. We are not held to check and inform You about the applicable
customs fees and taxes. To know them, We advise You to inform You at the proper
authorities of your country.
Article 5: Payment - Your order will be treated
only when your payment is received in our bank account. The payments can be by
e-mail Paypal, credit transfer or by paying cash. You have to choose between
these three options and specify it on the order request.
By Paypal: When You choose to pay with Paypal, note that a 5% surchage
fee of the total amount is added,
You will then receive an email to connect You on the site of Paypal in order to
proceed to your online payment. You then connect on Paypal and proceed to
payment. With Paypal, You can have an up-to-date status of your payment. Paypal
offers the best service for encrypted payments and counts more than 98 million
accounts throughout the world.
By Credit transfer: The bank details will be
communicated to you.
By Cash: You can
pay the item by cash when you come to pick it up by yourself or when we make
direct door to door delivery by our staff. Details are to be set up by both
parts in this situation.
When your payment is received, You will be informed by e-mail. If
the article you ordered is unavailable or the order cancelled before delivery
when we receive your payment, the total amount will be refunded (except payment
fees from Paypal) within three days after reception of the payment and
communication of your banking details. We reserve the right to cancel any order
at any time.

6: Returns – Please read
carefully this paragraph
Retractation

For any online purchase, the retractation period is 7 days after delivery. Any
return will have to be announced to Convert Design within a deadline of 7
calendar days. You will have to justify the date of delivery to benefit of
Retractation rule. Any return of the article will have to be organized and paid
by You. In any case, We could be held to organize the return of the cancelled
articles. After receiving the cancelled articles, and after checking their good
condition, You will be refunded for the returned articles, except for the
initial delivery expenses. Otherwise, no refund could be eligible.
Damaged product - We advise you to carefully
check the condition and the conformity of the articles delivered before any
signature on the delivery receipt. If your article is damaged or not in
conformity, We advise You to write down your comments on the
delivery receipt (brief description of the anomalies or deteriorations) and to
put your signature there. If no reserve is issued at the time of delivery, You
will have no other recourse against the conveyor.
Direct delivery by our staff – return will not be accepted
in
such
circumstances
Article 7 : Property rights - The ordered articles remain
our property until You have fullfilled all obligations towards us, and in
particular until the complete payment of Your purchase. After delivery of the
articles to You, You assume the exclusive responsibility of all related risks.
Article 8: Guarantees and responsibility - We
work with antique dealers from different countries. The articles posted on the
Site are in conformity with the applicable legislation and rules of the
concerned country. The photographs, texts, and characteristics of the articles
posted on the Site are not contractual. Consequently, We decline any
responsibility for any inaccuracy, error or omission relating to the
information available on this site. We decline any responsibility in case of
unavailability of the product, of delivery problem (delay of delivery,
deterioration, refusal of the customs...). In the same way, our responsibility
could not be involved in case of failure of one of our contractual obligations
due to a fortuitous or “act to god” occurrence , and We will not be responsible
for any type of losses included but not limited to losses of benefit, earnings,
and data and any other consequential damage or damage which was not foreseeable
at the moment of the use of the Site or the conclusion of the sale contract
between us. We will do our best to complete the services mentioned in these
general Conditions of sale.
Article 9: Personal data protection - We
commit ourselves to protect your personal data. All the personal data that We
collected are treated with high confidentiality.
Article 10: Litigations - In
case of litigation, we agree on trying to find friendly agreement. In absence
of friendly agreement, to hear any complaint due to interpretation, appliance,
achievement, effectiveness, validity and consequences of the general conditions
of Sale and the terms of use of the Site, the parties agree on electing the
exclusive competence to the legal district of Bucharest, Romania.
